From what I have observed, USCIS has been prioritizing marriage-based cases recently, while employment-based cases appear to be moving much more slowly. National Benefits Center is also processing cases at a sluggish pace, though the reason is unclear. So far, most cases I’ve seen are being approved within 6 to 8 months. Let’s see how USCIS handles employment based petitions moving forward. Wish you best.

It's longer bc the current admin isn't helping anything. Officers being asked to quit, layoffs, priority case changes, forced to office which means less cases, allowed less working hrs means less ot and less cases....executive orders of end remote work, layoffs and deny unions are the direct cause and the % will get worse....contact congress to stop the layoffs etc

My wife got her EAD immediately after biometrics in September. I got mine 6 months later, 7 months total wait, as the primary applicant.

She was on a non-working visa at the time, and I am on a work visa, so I can see why USCIS made her a priority.

I’m still waiting on my husbands work authorization. FD is March 31, 2025. Biometrics was May 6th. Haven’t heard a word since then. We are filed an I-485 and had a RFE for that one. Just wanting him to be able to work! All of our cases are through NBC.

I’ve been waiting awhile for my work authorization as well and my interview for my green card (marriage based ) is coming up end of Oct … if they don’t make their decision by my interview date what happens to paying for that ? Do they refund the work authorization back ?

The processing time for an I-765 (H-4 Dependent) is 12 months currently. Whereas a person can apply only 6 months before the expiry date. That means the person will be out of work authorization for 6 months at least.  
USCIS should reduce the processing times of I-765 in this case or introduce premium processing.

Not entirely unexpected, but still a huge hit. Sorry if this is a dumb question, but does anyone know if this will impact folks on CR-1 applying for removal of conditions? Will those people lose their work authorization during the crazy long I-751 processing time?

Exhibit #76 why it was never about legal immigration. If the immigrant was previously vetted for initial work authorization, and is now renewing it, what harm is done by allowing the immigrant to keep their work permit while they’re in renewal process? 

I can see no potential harm in that to the country and the government, but I can see immense harm to the immigrants who will now have lapses of employment every time they renew. 

And the fact that they published it as an interim rule, knowing that if they allowed for public comment period they’d get a lot of comments that they’ll have to deal with, is just ugh

Obviously not so good for people with pending cases but I have seen renewals and initial applications being approved faster now. The one benefit for those already here is that since there are no or very few people coming in via the border, USCIS is able to focus on existing cases rather than process new asylums and eventual EADs. 

Also, in practice the 540 day automatic extension was often ignored by employers and state driver's license agencies meaning that people who had cards that were expired often lost jobs regardless.

I applied for both the 9-12 &amp; 5-7. 

On my end, the 5-7 says cancelled. 9-12 is still active.

Spoke with the director of a local office and he said they may reopen the 5-7. I'm not holding my breath though.

Have you tried applying for an assistant position as well? Sometimes going that route first can help a lot. Ive known folks that took an assistant position and then got ISO not long after.

ISOs are under CIS. CIS is under DHS. CIS ≠ ICE.  

ISOs are responsible for the proper adjudication of immigration benefits cases. Their role is to serve as the direct liaison between the government and families applying for citizenship as a caseworker to ensure those in need are being taken care of. They also review applications for fraud and potential safety concerns.  

They're not associated with the kitted-out, masked-up ICE agents that have been rounding people up. ISOs are more like social workers, but for immigration benefits.
